General Terms and Conditions for Photographers

(Commissioned Photographs)

1. Scope
These terms and conditions apply to all services, offers, deliveries, and agreements provided by photographer Melanie Rudolph. By booking a photoshoot or photographic service, the client agrees to these terms.

2. Services
Melanie Rudolph offers photography services in the areas of portrait, lifestyle, family, children, newborn, events, weddings, outdoor, and branding. The exact scope of services is defined individually in each agreement.

3. Booking & Payment
A non-refundable deposit of 20% of the total price is required to secure the booking.
The remaining balance is due after completion of the assignment and must be paid via bank transfer.

4. Cancellation & Rescheduling
Cancellations are possible at any time but will be handled individually depending on how short notice the cancellation is. The deposit is non-refundable.
Rescheduling is possible depending on availability.

5. Editing & Delivery
Image selection and editing are carried out by the photographer.
Final images will be delivered via an online gallery, followed by a download link once completed.
The standard editing turnaround time is up to 2 weeks. In exceptional cases, delays will be communicated individually.

6. Usage Rights
Unless otherwise agreed, images are for private use only.
For branding and business shoots, commercial usage rights will be granted accordingly.
The photographer retains the right to use the images for portfolio purposes (e.g., website, social media).
If the client does not wish for their images to be used, this must be explicitly agreed upon in advance.

7. Raw Files
The delivery of unedited RAW files is excluded.

8. Liability & Cancellation by Photographer
In case of illness or inability to attend, an individual solution will be arranged. This may include providing a replacement photographer or rescheduling the session.
No liability is accepted for unforeseen circumstances beyond control, unless caused by gross negligence.

9. Final Provisions
The law of the country in which the photographer has her primary residence applies. Place of jurisdiction is the photographer’s place of residence, where legally permissible.
